A Clinton man is seeking more than $300,000 from the state after being wrongfully locked up for more than 5 years.
David DeSimone filed the claim Wednesday with the state appeals board. DeSimone was convicted in 2005 of sexually abusing a 17-year-old girl. Then he got a new trial in 2011 because prosecutors withheld important evidence. He was found not guilty. Last month, a Clinton County District Judge ruled he was wrongfully imprisoned, making him eligible for compensation. The state has filed an appeal of the ruling.
